Three witnesses testified that Omar Hooks had a gun the day of the shooting. None of them testified to seeing Omar shoot Thomas Green. Omar’s clothes were tested for gunshot residue. The test came back negative. Furthermore, crime scene investigators failed to send any evidence to a latent print examiner. Omar’s innocence could have been proved had this evidence was tested.
With negative ballistics tests and no physical evidence, Omar’s should not have been guilty beyond a reasonable doubt.
When Thomas Green, the victim, was murdered by a gun capable of firing 9mm bullets. This weapon was never recovered, nor was any evidence that could identify a potential suspect. Only one live 9mm round and one 9mm shell casing were found at the crime scene. Witnesses heard three to four shots.
