In Trial Transcripts, Officers state that an “Unknown Female” was seen taking the victim’s pulse, yet they failed to interview this witness. Another Officer claimed to walk through the crime scene, yet he could not testify to finding bullet casings—despite being the first on the scene.
Two other Officers, Tooey and Weigand, were also at the scene, and they were quoted in court saying:
“How did the items get around the scene if it was not you or Officer Tooey?”
“I don't know, it wasn't me” was Officer Weigand’s response.
Weigand does not know if Tooey moved any items prior to his arrival.
Weigand did not send any items out for fingerprint or DNA analysis. Is this because they were touched prior to his arrival by other people on the scene (including housing officers)?
